The Authorities has issued Decree 95/2024/ND-CP detailing numerous articles of the 2023 Housing Regulation. Specifically, the Decree regulates the development, sale, and lease of multi-storey multi-apartment homes (mini-apartments).
In accordance with this decree, a multi-storey home with many residences is a home with 2 flooring or extra designed and constructed for the aim of sale, lease-purchase or a mixture of sale, lease-purchase, lease or just for lease for every condominium.
The development of multi-storey homes with many residences is regulated as follows.
In case of development of multi-storey homes with many residences for hire, on the market or a mixture of sale, lease, lease-purchase or with a scale of 20 residences or extra for hire, it’s needed to hold out funding procedures for development of housing initiatives based on the provisions of the legislation on funding, the legislation on housing, the legislation on development and associated legal guidelines.

Within the case of constructing a multi-storey home with many residences with a scale of lower than 20 residences for hire, the development of this home should adjust to the rules on the development of particular person homes, together with necessities on design, development design appraisal, development allow issuance, development administration and supervision, and necessities on fireplace prevention and preventing security based on the provisions of legislation.

In case of housing development based on the provisions of Clause 1, Article 57 of the Housing Regulation or Clause 3, Article 57 of the Housing Regulation, with residences on the market or lease-purchase, the sale or lease-purchase of housing shall be carried out in accordance with the provisions of the legislation on actual property enterprise.
In case of constructing a home based on the provisions of Clause 3, Article 57 of the Housing Regulation, if there are residences for hire solely, the rental of the home shall be carried out in accordance with the provisions of the civil legislation and the housing legislation.
Notably, the granting of Certificates for every condominium to consumers and lessees as prescribed in Clause 1 of this Article is carried out in accordance with the provisions of the legislation on land.
As well as, the handover of residences on the market, lease, or rent buy is carried out based on the next rules.
For the case laid out in Clause 1 of this Article, the handover of housing shall be carried out in accordance with the provisions in Clause 4, Article 37 of the Housing Regulation and Article 25 of this Decree.
Within the case laid out in Clause 2 of this Article, the handover of housing shall be carried out in accordance with the signed housing lease contract.
